By accessing or using RepGPT, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.
RepGPT provides AI-powered sales automation tools including automated calling, email outreach, and lead management.
You are solely responsible for ensuring your use of RepGPT complies with all applicable laws including TCPA, state telemarketing laws, and DNC regulations. You represent and warrant that you have obtained all necessary consents from contacts before initiating outreach through RepGPT.
You (the Customer) agree to fully indemnify, defend, and hold harmless RepGPT, its parent company, founders, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the RepGPT platform; (b) your outreach campaigns, including but not limited to calls, emails, and messages initiated through the platform; (c) your failure to comply with TCPA, DNC, CAN-SPAM, or any applicable federal, state, or local telemarketing, privacy, or communications laws; (d) any claims by third parties (including recipients of calls or messages) alleging unsolicited or unauthorized contact; (e) the accuracy, legality, and consent status of any contact data you upload to the platform. You acknowledge that RepGPT is a technology platform and does not control, verify, or take responsibility for the content of your outreach or the consent status of your contacts.
RepGPT operates solely as a technology platform that executes outreach campaigns as configured and directed by the Customer. RepGPT does not independently select, verify, or approve contacts for outreach. RepGPT does not make representations about the consent status of any contacts uploaded by the Customer. The Customer is the initiator and controller of all outreach conducted through the platform. RepGPT's role is limited to providing the technology infrastructure to execute the Customer's campaigns.
RepGPT is provided 'as is' without warranties of any kind, express or implied. RepGPT shall not be liable for any indirect, incidental, special, or consequential damages. Our total aggregate liability shall not exceed the total amount you have paid to RepGPT in the 12 months preceding the claim.
RepGPT does not guarantee any specific sales outcomes, meeting bookings, conversion rates, or revenue generation. Results vary based on industry, lead quality, and market conditions.
RepGPT uses artificial intelligence to conduct outreach on your behalf, including AI-generated voice calls and AI-written emails. You acknowledge that AI-generated communications may not always be perfect and you accept responsibility for monitoring and managing your AI rep's activity.
Your use of RepGPT is also governed by our Privacy Policy at /privacy.
Either party may terminate the agreement at any time. Upon termination, your data will be retained for 30 days and then permanently deleted.
These Terms shall be governed by the laws of the State of Texas. Any disputes arising from or relating to these Terms or the use of RepGPT shall be resolved through binding arbitration in Dallas, Texas, under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
